These Terms of Service ("Terms") are an agreement between you and Cartava App LLC ("Cartava," "we," "us"), based in Westerville, Ohio, USA. By downloading or using the Cartava app or visiting cartava.app, you agree to these Terms. If you don't agree, please don't use the app.
Cartava is a gift card organization tool. It lets you store gift card details, barcodes, and balances on your device, receive location-based and time-based reminders, and view spending insights. Cartava does not issue gift cards, hold funds, process payments, or have any relationship with the retailers whose cards you store.
We grant you a personal, non-exclusive, non-transferable, revocable license to use Cartava on Apple devices you own or control, in accordance with these Terms and Apple's App Store terms. You may not copy, modify, reverse-engineer, resell, or redistribute the app or any part of it.
Gift card balances shown in Cartava reflect the amounts you've entered or updated, and may not match the actual balance held by the retailer. The retailer that issued your gift card is solely responsible for its value, redemption, expiration policies, and fees. Cartava is not liable for expired cards, inactivity fees, retailer refusals, or discrepancies between recorded and actual balances.
Nearby alerts and reminders are provided on a best-effort basis and depend on iOS permissions, device settings, connectivity, and Apple's location services. We do not guarantee that any notification will be delivered at a particular time or place, and you should not rely on Cartava as your only reminder for expiring cards or fees.
The Cartava app, website, name, logo, and design are the property of Cartava App LLC. Retailer names and logos referenced by users within the app belong to their respective owners; their appearance does not imply any affiliation with or endorsement by those retailers.
Cartava is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any data you store will never be lost.
To the maximum extent permitted by law, Cartava App LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, gift card value, data, or goodwill arising from your use of the app. In no event will our total liability exceed the greater of the amount you paid us in the past twelve months (currently $0, since the app is free) or fifty US dollars ($50).
We may add, change, or remove features at any time, and may update these Terms as the app evolves. When we do, we'll update the "Last updated" date above and, for significant changes, notify you in the app. Continued use after changes means you accept the updated Terms.
You can stop using Cartava at any time by deleting the app. We may suspend or terminate your license if you violate these Terms. Sections that by their nature should survive (including disclaimers, limitation of liability, and governing law) survive termination.
These Terms are between you and Cartava App LLC, not Apple. Apple has no obligation to provide support or maintenance for the app and is not responsible for addressing any claims relating to it. Apple is a third-party beneficiary of these Terms and may enforce them against you.
These Terms are governed by the laws of the State of Ohio, USA, without regard to conflict-of-law principles. Any disputes will be resolved in the state or federal courts located in Ohio.
